This Legal Notice forms an integral part of all communications, invoices, delivery orders, debit notes, quotations, transactions, and services provided by the Agency Company, unless otherwise expressly agreed in writing.
Legal Notice Regarding the Scope of Authority of the Shipping Agency<\/p>\n\n\n\n
Notice to all customers, cargo owners, shippers, consignees, customs brokers, freight forwarders, and all other interested parties:<\/p>\n\n\n\n
This Company acts solely as the duly appointed local agent of the Shipping Line within the territory of the Islamic Republic of Iran. The Company\u2019s authority is strictly limited to the powers granted under the Agency Agreement concluded with the Shipping Line and the instructions, policies, and directives issued by the Shipping Line from time to time.<\/p>\n\n\n\n
Accordingly, all decisions relating to the performance of the contract of carriage and maritime operations, including but not limited to the following, are made exclusively by the Shipping Line:<\/p>\n\n\n\n
* Determination or amendment of vessel schedules;<\/p>\n\n\n\n
* Deviation from the scheduled or customary voyage;<\/p>\n\n\n\n
* Omission, substitution, or alteration of ports of loading or discharge;<\/p>\n\n\n\n
* Discharge of cargo at an alternative, substitute, or safe port;<\/p>\n\n\n\n
* Transshipment of cargo to another vessel or means of transport;<\/p>\n\n\n\n
* Suspension, interruption, postponement, or termination of carriage operations;<\/p>\n\n\n\n
* Imposition of charges arising from operational conditions, war, force majeure, sanctions, port congestion, security risks, governmental restrictions, or other extraordinary circumstances;<\/p>\n\n\n\n
* Determination, amendment, revision, or notification of freight, port charges, operational charges, diversion costs, transshipment costs, storage charges, demurrage, detention, and all other charges relating to the contract of carriage.<\/p>\n\n\n\n
The Agency Company has no authority or discretion whatsoever to make, amend, revoke, reduce, increase, waive, negotiate, or otherwise alter any operational decision, tariff, invoice, surcharge, freight, charge, or instruction issued by the Shipping Line.<\/p>\n\n\n\n
All invoices, debit notes, notices, operational advisories, instructions, communications, and other documents issued or delivered by the Agency Company are prepared and transmitted solely in the performance of its agency functions and strictly in accordance with the official instructions, tariffs, rates, invoices, and information provided by the Shipping Line. The issuance or communication of such documents shall not be construed as an independent decision, representation, undertaking, or contractual commitment by the Agency Company beyond the authority expressly granted to it.<\/p>\n\n\n\n
Any objection, complaint, claim, or dispute concerning operational decisions of the Shipping Line, including but not limited to voyage deviation, discharge of cargo at an alternative port, additional freight, operational surcharges, emergency charges, war-related charges, force majeure measures, port restrictions, or any other matter relating to the contract of carriage, shall, in substance, be directed to the Shipping Line. The Agency Company shall only be responsible for receiving, recording, and forwarding such claims, supporting documents, and correspondence to the Shipping Line and for communicating the Shipping Line\u2019s responses to the relevant parties.<\/p>\n\n\n\n
Furthermore, the Agency Company is not authorized to accept, reject, compromise, settle, waive, refund, adjust, amend, or otherwise dispose of any claim, freight, surcharge, invoice, or charge imposed by the Shipping Line. Any modification, cancellation, reduction, or adjustment of such amounts shall be valid only upon the prior written approval and instruction of the Shipping Line.<\/p>\n\n\n\n
Any person requesting transportation services, issuance of shipping documents, cargo delivery, cargo release, customs clearance, payment of freight or charges, or engaging in any correspondence or transaction with the Agency Company shall be deemed to have acknowledged and accepted the limited scope of the Agency Company\u2019s authority as defined by applicable laws, the contract of carriage, the terms and conditions of the Bill of Lading, and the Shipping Line\u2019s applicable tariffs and instructions.<\/p>\n\n\n\n
